OHIO SUPREME COURT REACHES FAVORABLE DECISION

On March 23, 2010, The Ohio Supreme Court announced a long-awaited decision regarding the constitutionality of Ohio’s employer intentional tort statute (R.C. 2745.01). In two decisions authored by Justice Cupp, the Court upheld the constitutionality of the statute, which provides that an employee asserting an intentional tort claim against his employer must prove that the employer acted (or failed to act) “with a deliberate intent to cause injury.”
